Renforc\u00e9e par la Loi sant\u00e9 au travail, la n\u00e9gociation de la QVT doit r\u00e9pondre \u00e0 des crit\u00e8res stricts. Mais quels sont-ils ?<\/p>\n<\/div>\n<div class=\"entry-content\">\n<div id=\"cultu-1635876761\" class=\"cultu-inread-top\">\n<div id=\"cultu-975798124\" class=\"cultu-target\" data-advadstrackid=\"22938\" data-advadstrackbid=\"1\"><span style=\"font-size: 16px;\">La d\u00e9marche Qualit\u00e9 de Vie au Travail, ou encore QVT, permet non seulement d\u2019am\u00e9liorer les conditions de travail, mais \u00e9galement de mieux concilier les temps de vie professionnelle et personnelle des salari\u00e9s. Cette d\u00e9marche peut se mat\u00e9rialiser par la conclusion et la mise en place d\u2019un accord QVT au sein de l\u2019entreprise. Cet accord permet de concr\u00e9tiser cette d\u00e9marche, et de l\u2019adapter en fonction des sp\u00e9cificit\u00e9s et des probl\u00e9matiques de l\u2019entreprise ainsi que des besoins de ses salari\u00e9s.<\/span><\/div>\n<\/div>\n<p>La n\u00e9gociation sur la QVT constitue \u00e9galement une obligation l\u00e9gale pour certaines entreprises. Cette n\u00e9gociation a pris un nouveau tournant\u00a0avec la\u00a0<a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/id\/LEGIARTI000043886747\/2022-03-31\/\">loi \u00ab\u00a0sant\u00e9 au travail\u00a0\u00bb du 2 ao\u00fbt 2021<\/a>\u00a0: la QVT devient la QVCT, et peut d\u00e9sormais int\u00e9grer les questions des conditions de travail depuis le 31 mars 2022.<\/p>\n<div class=\"ez-toc-section\"><\/span>Les n\u00e9gociations obligatoires en entreprises\u00a0: rappel<\/h3>\n<p>Le Code du travail (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000035627878\">article L2242-1<\/a>) pr\u00e9voit l\u2019engagement r\u00e9gulier de n\u00e9gociations obligatoires dans les entreprises dot\u00e9es d\u2019une section syndicale (en pratique, celles o\u00f9 est d\u00e9sign\u00e9 un d\u00e9l\u00e9gu\u00e9 syndical).<\/p>\n<p>Les n\u00e9gociations doivent porter \u00ab\u00a0sur la r\u00e9mun\u00e9ration, notamment les salaires effectifs, le temps de travail et le partage de la valeur ajout\u00e9e dans l\u2019entreprise\u00a0\u00bb, ainsi que \u00ab\u00a0sur\u00a0<a href=\"https:\/\/culture-rh.com\/index-egalite-femmes-hommes-definition-calcul-utilite\/\">l\u2019\u00e9galit\u00e9 professionnelle entre les femmes et les hommes<\/a>, portant notamment sur les mesures visant \u00e0 supprimer les \u00e9carts de r\u00e9mun\u00e9ration, et la qualit\u00e9 de vie et des conditions de travail\u00a0\u00bb.<\/p>\n<p>\u00c0 d\u00e9faut d\u2019accord de m\u00e9thode fixant le cadre de ces n\u00e9gociations, elles doivent \u00eatre engag\u00e9es tous les ans. En pr\u00e9sence d\u2019un tel accord, la n\u00e9gociation peut avoir lieu au maximum tous les quatre ans.<\/p>\n<p>En outre, les entreprises d\u2019au moins 300 salari\u00e9s doivent \u00e9galement engager tous les trois ans une n\u00e9gociation sur la gestion des emplois et des parcours professionnels (GEPP).<\/p>\n<h3><span id=\"Les_contours_de_lobligation_de_la_negociation_sur_la_QVT\" class=\"ez-toc-section\"><\/span>Les contours de l\u2019obligation de la n\u00e9gociation sur la QVT<\/h3>\n<h4>Les 7 sous-th\u00e8mes de n\u00e9gociation<\/h4>\n<p><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039785096\/\">L\u2019article L.2242.17 du code du travail<\/a>\u00a0pr\u00e9voit 7 sous-th\u00e8mes de n\u00e9gociation\u00a0:<\/p>\n<ul>\n<li>L\u2019articulation entre la vie personnelle et la vie professionnelle pour les salari\u00e9s.<\/li>\n<li>Les objectifs et les mesures permettant d\u2019atteindre l\u2019\u00e9galit\u00e9 professionnelle entre les femmes et les hommes.<\/li>\n<li>Les mesures permettant de lutter contre toute discrimination.<\/li>\n<li>Les mesures relatives \u00e0 l\u2019insertion professionnelle et au maintien dans l\u2019emploi des travailleurs handicap\u00e9s.<\/li>\n<li>Les modalit\u00e9s de d\u00e9finition d\u2019un r\u00e9gime de pr\u00e9voyance.<\/li>\n<li>L\u2019exercice du droit d\u2019expression directe et collective des salari\u00e9s.<\/li>\n<li>Les modalit\u00e9s d\u2019exercice du\u00a0<a href=\"https:\/\/culture-rh.com\/exemple-droit-a-la-deconnexion-regles-obligations-penalites-charte\/\">droit \u00e0 la d\u00e9connexion\u00a0<\/a>pour assurer le respect de la vie personnelle et familiale des salari\u00e9s.<\/li>\n<li>Dans les entreprises de plus de 50 salari\u00e9s et dot\u00e9es d\u2019une section syndicale\u00a0: les mesures visant \u00e0 am\u00e9liorer la mobilit\u00e9 des salari\u00e9s entre leur lieu de r\u00e9sidence habituelle et leur lieu de travail.<\/li>\n<\/ul>\n<h4>Le cadre juridique de la n\u00e9gociation<\/h4>\n<p><strong>La n\u00e9gociation doit \u00eatre engag\u00e9e tous les ans, ou au moins une fois tous les quatre ans en pr\u00e9sence d\u2019un accord d\u00e9finissant la p\u00e9riodicit\u00e9<\/strong>. Avant toute n\u00e9gociation, il est important de v\u00e9rifier s\u2019il existe des dispositions n\u00e9goci\u00e9es conventionnellement au niveau de la branche d\u2019activit\u00e9 de l\u2019entreprise et de s\u2019y conformer, le cas \u00e9ch\u00e9ant.<\/p>\n<p>Lorsque la n\u00e9gociation est en cours, l\u2019entreprise ne peut pas prendre de d\u00e9cisions unilat\u00e9rales sur les sujets n\u00e9goci\u00e9s, sauf en cas d\u2019urgence ou concernant des cas individuels.<\/p>\n<p>L\u2019employeur a l\u2019obligation d\u2019entamer des n\u00e9gociations, mais si aucun accord n\u2019est conclu, il sera alors \u00e9tabli un proc\u00e8s-verbal de d\u00e9saccord. Ce PV doit consigner les propositions des parties et les mesures unilat\u00e9rales que l\u2019employeur s\u2019engage \u00e0 appliquer.<\/p>\n<form id=\"mc4wp-form-2\" class=\"mc4wp-form mc4wp-form-2755\" method=\"post\" data-id=\"2755\" data-name=\"Newsletter hebdo\">\n<div class=\"mc4wp-form-fields\">\n<p class=\"btn-abonnement\"><span style=\"font-size: 1.3em; font-weight: bold;\">Des n\u00e9gociations s\u00e9rieuses et loyales<\/span><\/p>\n<\/div>\n<\/form>\n<p>L\u2019employeur doit s\u00e9rieusement et loyalement engager les n\u00e9gociations avec les partenaires sociaux. Il doit alors convoquer toutes les organisations syndicales repr\u00e9sentatives dans l\u2019entreprise, et \u00e9galement leur transmettre toutes les informations n\u00e9cessaires afin qu\u2019elles puissent n\u00e9gocier.<\/p>\n<h3><span id=\"Laccord_dadaptation_sur_la_negociation_QVT\" class=\"ez-toc-section\"><\/span>L\u2019accord d\u2019adaptation sur la n\u00e9gociation QVT<\/h3>\n<p>L\u2019employeur ou les syndicats peuvent \u00eatre \u00e0 l\u2019initiative de la n\u00e9gociation d\u2019un accord d\u2019adaptation concernant la n\u00e9gociation obligatoire sur la qualit\u00e9 de vie au travail. Ils peuvent alors fixer le cadre de cette n\u00e9gociation, et ainsi l\u2019adapter au contexte de l\u2019entreprise. Il est alors possible de d\u00e9finir :<\/p>\n<ul>\n<li>La p\u00e9riodicit\u00e9 des n\u00e9gociations\u00a0: au maximum tous les quatre ans, il n\u2019est donc plus n\u00e9cessaire de n\u00e9gocier tous les ans.<\/li>\n<li>Le calendrier et lieu\u00a0: par exemple que les n\u00e9gociations seront engag\u00e9es en janvier, l\u2019employeur communiquera les informations avant une date fix\u00e9e, les r\u00e9unions de n\u00e9gociation auront lieu toutes les 2 semaines, etc.<\/li>\n<li>Les th\u00e8mes de n\u00e9gociation, et notamment celui des conditions de travail.<\/li>\n<li>Les modalit\u00e9s (notamment de mise en place des indicateurs, de suivi des engagements).<\/li>\n<li>Les informations remises aux n\u00e9gociateurs.<\/li>\n<li>Il est \u00e9galement possible de pr\u00e9voir que l\u2019accord QVT s\u2019applique \u00e0 l\u2019\u00e9tablissement, \u00e0 l\u2019entreprise ou au groupe.<\/li>\n<\/ul>\n<p>Cet accord d\u2019adaptation, dont les dispositions sont pr\u00e9vues par les\u00a0<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000035627827\/\">articles L. 2242-10<\/a>\u00a0et\u00a0<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000036761810\/2022-05-13\">L. 2242-11<\/a>\u00a0du Code du travail, a une dur\u00e9e maximale de quatre ans.<\/p>\n<h3><span id=\"Les_sanctions_en_cas_de_non-negociation_de_laccord\" class=\"ez-toc-section\"><\/span>Les sanctions en cas de non-n\u00e9gociation de l\u2019accord<\/h3>\n<p>C\u2019est \u00e0 l\u2019employeur d\u2019engager les n\u00e9gociations concernant la QVT (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000035627878\">article L. 2242-1 du code du travail<\/a>).\u00a0En cas de d\u00e9faut de n\u00e9gociation de l\u2019accord, il risque une peine d\u2019un an d\u2019emprisonnement et d\u2019une amende de 3750 \u20ac.<\/p>\n<div id=\"cultu-1113211916\" class=\"cultu-inread\">\n<div id=\"cultu-1999332746\" class=\"cultu-target\" data-advadstrackid=\"23025\" data-advadstrackbid=\"1\"><span style=\"font-size: 16px;\">En outre, une p\u00e9nalit\u00e9 financi\u00e8re est pr\u00e9vue pour les entreprises d\u2019au moins 50 salari\u00e9s qui n\u2019ont pas respect\u00e9 leur obligation concernant la conclusion sur l\u2019\u00e9galit\u00e9 professionnelle ou qui ne sont pas dot\u00e9es d\u2019un plan d\u2019action sur ce th\u00e8me.<\/span><\/div>\n<\/div>\n<h2><span id=\"Comment_mettre_en_place_la_negociation_sur_la_QVT\" class=\"ez-toc-section\"><\/span>Comment mettre en place la n\u00e9gociation sur la QVT\u00a0?<\/h2>\n<h3><span id=\"Quelles_sont_les_differentes_etapes_de_la_negociation\" class=\"ez-toc-section\"><\/span>Quelles sont les diff\u00e9rentes \u00e9tapes de la n\u00e9gociation\u00a0?<\/h3>\n<figure class=\"wp-block-image size-large\"><img fetchpriority=\"high\" decoding=\"async\" class=\"wp-image-22850 lazyloaded\" src=\"https:\/\/culture-rh.com\/wp-content\/uploads\/2022\/05\/etapes-nego-qvt-1-410x1024.png\" sizes=\"(max-width: 410px) 100vw, 410px\" srcset=\"https:\/\/culture-rh.com\/wp-content\/uploads\/2022\/05\/etapes-nego-qvt-1-410x1024.png 410w, https:\/\/culture-rh.com\/wp-content\/uploads\/2022\/05\/etapes-nego-qvt-1-240x600.png 240w, https:\/\/culture-rh.com\/wp-content\/uploads\/2022\/05\/etapes-nego-qvt-1-768x1920.png 768w, https:\/\/culture-rh.com\/wp-content\/uploads\/2022\/05\/etapes-nego-qvt-1-72x180.png 72w, https:\/\/culture-rh.com\/wp-content\/uploads\/2022\/05\/etapes-nego-qvt-1.png 800w\" alt=\"\u00e9tapes-n\u00e9gociation-accord-QVT-diagnostic\" width=\"410\" height=\"1024\" data-ll-status=\"loaded\" \/><\/figure>\n<p>La n\u00e9gociation sur la QVT peut se d\u00e9rouler en quatre \u00e9tapes qui ont toutes leur importance\u00a0:<\/p>\n<h4>1<sup>\u00e8re<\/sup>\u00a0\u00e9tape\u00a0=&gt; Le diagnostic<\/h4>\n<p>La r\u00e9alisation d\u2019un diagnostic des conditions de travail permet l\u2019identification des probl\u00e9matiques \u00e0 cibler.<\/p>\n<p>Le diagnostic peut se faire sur la base de l\u2019analyse des donn\u00e9es sociales\u00a0:\u00a0<a href=\"https:\/\/culture-rh.com\/taux-turnover-entreprise-mesurer-analyser-reduire-definition\/\">turn-over<\/a>,\u00a0<a href=\"https:\/\/culture-rh.com\/comment-reduire-absenteisme-travail\/\">absent\u00e9isme<\/a>, \u00e9tude des accidents du travail et des maladies professionnelles. Le\u00a0<a href=\"https:\/\/culture-rh.com\/duerp-comment-evaluer-risques-professionnels\/\">DUERP<\/a>\u00a0(Document Unique d\u2019\u00c9valuation des Risques Professionnels) et le rapport du m\u00e9decin du travail sont \u00e9galement des sources d\u2019information importantes.<\/p>\n<h4>2\u00e8me \u00e9tape\u00a0=&gt; Le plan d\u2019action<\/h4>\n<p>La d\u00e9finition des objectifs permet de mettre en place un plan d\u2019action concret, ainsi que de d\u00e9finir les moyens \u00e0 allouer. Il est important de prendre de vrais engagements, qui s\u2019inscrivent sur la dur\u00e9e. Ces objectifs doivent \u00eatre r\u00e9alisables et atteignables.<\/p>\n<h4>3\u00e8me \u00e9tape\u00a0=&gt; La d\u00e9finition d\u2019indicateurs de suivi<\/h4>\n<p>La mise en place d\u2019indicateurs permet un suivi plus efficace de l\u2019accord et des actions men\u00e9es.<\/p>\n<h4>4\u00e8me \u00e9tape\u00a0=&gt; Le suivi et l\u2019\u00e9valuation des mesures<\/h4>\n<p>Le suivi (le plus souvent annuel) de l\u2019accord et l\u2019\u00e9valuation de l\u2019efficacit\u00e9 des mesures mises en place permettent de dresser un bilan des actions men\u00e9es, et de pr\u00e9parer la n\u00e9gociation de l\u2019accord suivant, afin d\u2019ajuster les actions \u00e0 mener si n\u00e9cessaires.<\/p>\n<h3><span id=\"Limplication_des_parties_prenantes_une_demarche_co-construite\" class=\"ez-toc-section\"><\/span>L\u2019implication des parties prenantes\u00a0: une d\u00e9marche co-construite<\/h3>\n<p>Il est important d\u2019impliquer toutes les parties prenantes (salari\u00e9s, managers, repr\u00e9sentants du personnel) \u00e0 la n\u00e9gociation sur la QVT.<\/p>\n<h4>Les salari\u00e9s et les managers<\/h4>\n<p>Les salari\u00e9s et les managers peuvent \u00eatre impliqu\u00e9s au sein de la d\u00e9marche QVT par le biais de groupe d\u2019expression, d\u2019enqu\u00eates.
